Terms and Conditions
1. Hey there! Just a heads-up: by using the Offerboat app, you're agreeing to a few key things. First off, Offerboat is basically a matchmaking platform for boat rentals—we're not directly involved in the rental agreements or transactions between renters and boat owners. Our app lets renters check out available boats and connect with owners to make bookings, and remember that everything about the rental itself, from the boat’s condition to payment and safety, is totally between the renter and the owner. So, owners, it's up to you to make sure your boat's ready to go, and renters, you're responsible for handling the rental properly. Offerboat’s here to help you connect, but the rest is on you!
2. Just so we're clear, by using Offerboat, you're acknowledging that we’re simply a platform—nothing more. We don’t have any direct control over the boats you rent through the app or website. The choices you make, the training you get, and any rules on board are entirely your responsibility, not ours. If anything happens during your rental, you agree not to hold Offerboat accountable for any claims that might come up.
3. I confirm that I’m 18 or older and get that only people who meet this age requirement are allowed on the boats. If I don’t meet this standard, I understand I’m not allowed to use the app.
4. I understand that the app is intended only for proficient swimmers. I acknowledge that as the renter, it’s my responsibility to ensure that everyone in my party is also a capable swimmer. If anyone in my group isn’t, I won’t access the app or proceed with the rental. Non-swimmers are prohibited from using the app, and I agree to comply with this rule.
5. I agree that no alcohol is allowed on the boats, and as the renter, I take full responsibility for ensuring that everyone in my party follows this rule. If I or anyone in my group plans to consume alcohol, I understand that we are prohibited from using the app, and I will refrain from accessing it under those circumstances.
6. I acknowledge that wearing a life preserver at all times while on the boat is mandatory. As the renter, I agree to ensure that everyone in my party follows this requirement. If I or anyone in my group does not intend to wear a life preserver, I understand that we are prohibited from using the app and will refrain from accessing it.
7. You agree that weapons of any kind are a no-go on the boat. This means no guns, knives, pepper spray, stun guns, tasers, batons, brass knuckles, machetes, swords, or anything else that could be considered a weapon. And as the renter, you’re also responsible for making sure that everyone in your party follows this rule too. Let’s keep it safe and fun!
8. You agree to comply with all lawful requests from state, local, and federal law enforcement officers, including game wardens and other regulatory agents. It's important to follow these requests, except in cases where it could violate your rights. Let's make sure we're all on the right side of the law while enjoying our time on the water!
9. You agree that using drones is only allowed in areas where it's legal and never while the boat is moving. If you're flying a drone for commercial purposes, you need to have an FAA Part 107 license and follow all FAA flight requirements, including any notifications and restrictions. Also, you must inform the boat owner about your intention to fly a drone from their boat and get their approval before doing so. You assume all responsibility for any damages caused by the drone in case of an accident involving property or people. If you're using the drone commercially, you agree to add Offerboat as an additional insured on a policy of no less than $1 million USD. Make sure to list Offerboat at 1951 NW S River Drive, Miami, FL 33125 as an additional insured, and email the insurance certificate to support@offerboat before your flight. Let’s keep it safe and enjoyable for everyone!
10. You agree that nudity or flashing in public is illegal and can lead to civil and/or criminal charges. Let’s keep things respectful and fun while we’re out on the water!
11. If you’re using the boat for any commercial activities like filming a video, doing a photoshoot, making a movie, or promoting something, you need to add Offerboat as an additional insured on a liability policy of at least $1 million USD. Make sure to list Offerboat at 1951 S River Drive, Miami, FL 33125, and email the certificate to support@offerboat.com. Let’s keep everything above board while you’re working!

If you plan to move around while the boat is moving, you’re not permitted to use Offerboat. To keep everyone safe, renters should stay in the same area while the boat is underway to minimize the risk of falling overboard. Let’s make sure we all stay safe and have a great time!
14. You agree that balloons are not allowed on board. Balloons can harm waterways, so any decorations involving them are strictly off-limits. Let’s keep our waters clean and beautiful for everyone to enjoy!

17. You agree that the boat has high-speed propellers for propulsion, and it’s super important to keep your feet or any body parts away from the back of the boat. Dangling anything over the edge can lead to serious injury, dismemberment, or even death from contact with the propellers. You understand that getting too close to the propellers poses a major risk that could cause great bodily harm or death. Let’s keep it safe and enjoy our time on the water!
18. You agree that swimming in the waters can come with inherent dangers from aquatic and marine life, including but not limited to sharks, rays, jellyfish, snakes, alligators, crocodiles, and other potentially dangerous animals. By choosing to swim, you accept all the risks that come with these hazards. Stay safe and enjoy your time in the water!
19. You understand that water currents can be really strong and pose a significant danger to swimmers, potentially carrying them away. Swimming in areas with currents is something you do at your own risk. Stay aware and be safe while enjoying the water!
20. You agree that Offerboat doesn’t allow the rental of a boat and a jet ski or any other personal watercraft (PWC) at the same time while you’re out on the water. If you plan to rent a jet ski or PWC, you won’t be able to use the Offerboat app. Let’s keep it safe and enjoyable for everyone!
21. You acknowledge that you’ve read and understood these rules, and you take full responsibility for following them while using the Offerboat app and during your time on the boats. You agree to comply with all the rules outlined in the Offerboat Terms of Service and to make sure everyone in your party is aware of and follows these rules. Let’s make sure everyone has a great and safe experience!

25. Compliance with Laws: Remember, you’ve got to follow all local, state, and federal laws regarding drug use and possession. We can’t take responsibility for any legal trouble that might come up from violations of this policy.
26. Consequences of Violation: If anyone violates this policy, they might get booted from the platform and could face legal action. We just want to make sure everyone is having a safe and fun time!
27. By using the Offerboat app, you’re saying that you get it and agree to this Drug Prohibition Policy. Let’s keep things safe and enjoyable out on the water!

33. By using the Offerboat app, you’re saying that you understand and accept this Illegal Acts Policy. Let’s keep our adventures enjoyable and within the law!
34. You’re totally responsible for using all safety equipment properly while you’re on board any rented vessel. This includes, but isn’t limited to, life preservers and fire extinguishers. So, make sure you know where everything is and how to use it—safety first!
35. Operating a boat while under the influence of alcohol or drugs is strictly prohibited. If you choose to do so, you assume all risks and liabilities for any incidents that may result. Let’s keep our boating adventures safe and enjoyable!
36. It’s important to acknowledge that you need to be competent to operate any rented boat. By agreeing to this, you’re accepting all the risks and liabilities that come with negligent or reckless boat operation. Stay safe out there!
37. Just so we’re clear, if anything happens—like an accident or someone gets hurt while you're using a rented boat—it’s all on you. Whether it’s a collision or an injury, you’ll be responsible for it. So, let’s make sure to be careful and avoid any issues while out on the water!
38. Here’s the deal: if there’s any environmental damage—like an oil spill or harm to marine habitats—it’s your responsibility. That includes any fines or liabilities that might come with it. Let’s make sure we’re protecting the waters while we’re out enjoying them!
39. Just a heads up—Offerboat doesn’t inspect or verify the condition of the boats listed on the app. By renting, you’re accepting the risks that come with a boat that might not be in perfect shape. It's a good idea to double-check things yourself to make sure everything’s in order before heading out!
40. Just so you know, Offerboat isn't responsible for any accidents, injuries, or damages caused by acts of nature or sudden weather changes. It’s up to you to keep an eye on the weather and make decisions that keep everyone safe. Stay alert and plan ahead!
41. There’s something to keep in mind: Offerboat doesn’t verify the accuracy of info shared by other users, whether it’s about the boat’s capabilities or the renter’s experience. By using the app, you accept any risks that come with relying on this information. Make sure to ask questions and do your own research before you commit!
42. Just so we’re clear, minors aren’t allowed on boats rented through Offerboat. If, for any reason, an unsupervised minor ends up on board, you’re fully responsible for their safety and behavior. It’s important to keep everyone safe and follow the rules!
43. You understand that Offerboat isn't responsible for your personal stuff if it gets lost, damaged, or stolen during your rental. Make sure to keep an eye on your belongings while you're out on the water. It’s all on you to keep them safe!
44. Just a heads up: it's really important that you understand and follow all the local boating rules—like speed limits and any restricted areas. By agreeing to this, you're taking on the responsibility to stay in the know and handle any risks that come with it. So, let’s keep it safe out there!
45. You get that it’s your responsibility to be prepared for any medical emergencies that might pop up while you’re on board. Offerboat isn’t liable for any medical incidents or delays in getting help, so it’s a good idea to have a plan in place just in case. Better safe than sorry!
46. You understand that it’s on you to make sure that only people who are authorized operate the rented boat. If someone unauthorized hops on the controls, you’ll take responsibility for any issues that arise from that. It’s all about keeping things safe and sound!
47. You get that Offerboat isn’t in charge of keeping the rented boats maintained or ensuring they’re in tip-top mechanical shape. If something goes wrong or there’s a breakdown, that risk is yours to take. Just a heads-up to keep safety in mind while you’re out on the water!
48. You understand that Offerboat won’t step in to handle any disputes about security deposits between Renters and Members. If there’s an issue, it’s up to you and the other party to sort it out. Just wanted to make sure you’re in the loop on that!
49. You get that boating comes with its own set of risks—things like drowning, collisions, and other hazards can happen. By choosing to participate, you’re accepting all those risks. Just wanted to make sure you’re aware!
50. You understand that if anything comes up—like claims, damages, or liabilities—because of your use of the Offerboat service or a boat rental, you’re agreeing to take responsibility and keep Offerboat out of any trouble. Just a heads-up!
51. You get that Offerboat isn't responsible for what third-party service providers do or any hiccups they might have—this includes payment processors and insurance providers. So, if anything goes wrong, you’re taking on that risk. Just keeping it real!
52. I take full responsibility for what I do and any consequences that might come from not following these rules. I understand that Offerboat won't be liable for any injuries, damages, or losses if I don't stick to these requirements. By using the Offerboat app, I'm confirming that I get it and accept all of this.
53. You agree to take reasonable steps to ensure that any user-generated content is accurate and reliable. Just a heads up, we're not responsible for the condition of the boats listed or for making sure that all laws and regulations regarding boat operation, maintenance, rental, or charter are followed.
54. As a Member, it's your responsibility to comply with all applicable laws and regulations in your area. Renters, please double-check that the boat you rent meets all legal and safety standards. Both Members and Renters are responsible for following these requirements.
55. Members should check if renting a boat is allowed and ensure it's clean and equipped with sanitation supplies for Renters after use. Renters, please return the boat in good condition using the supplies provided.
56. Before you book or purchase anything, just a heads up that you’ll need to sign a separate agreement or waiver with the Member. These agreements might have some extra rules for your booking, so it’s good to be aware. Also, any agreements about renting a boat or related services are entirely between you and the Member.
57. If there's ever a disagreement between a Renter and a Member, we want to make it clear that both of you agree to keep Offerboat out of it. Essentially, you both take responsibility for any claims, losses, or legal issues that might arise from the situation. This includes anything related to the terms of this agreement, other agreements, or any issues with the rental units. And just to clarify, both the Member and the Renter are on the hook for any claims that might come up because of your actions—whether that's breaking the rules we’ve set, running into legal issues, or any problems that pop up while using Offerboat's services. We designed this to protect Offerboat as much as legally possible, so everyone can enjoy a smooth sailing experience!
58. You get that Offerboat isn't responsible for providing insurance coverage for you, right? Any insurance that you might have is your own deal and doesn't involve Offerboat at all. We really recommend that you look into getting the right insurance to cover any potential risks related to your rental—this could include anything from personal safety to protecting your belongings or making sure your trip goes smoothly on the day you choose. It’s all about keeping you and your experience safe!
59. Just a heads up: the info we share about our services isn't meant to be used or shared by anyone in places where that could break local laws or put us in a tricky spot with regulations. So, if you're thinking of accessing our services from somewhere they weren't intended for, you're doing it at your own risk. It’s up to you to make sure you're following any local laws that apply. Stay safe out there!
60. Just a heads-up: our services aren’t designed to meet certain industry regulations, like HIPAA or FISMA. If you’re in a situation where those apply, it’s best not to use our services. Also, we want to make sure you’re not using our services in a way that goes against the Gramm-Leach-Bliley Act (GLBA). We appreciate your understanding! 61. Our services are all about making it easy for you to list and book boats. When it comes to the boats, they’re listed by their Owners right here on our platform. You can check out the listings as a guest, but if you want to book a boat or create your own listing, you’ll need to register for an Offerboat account first.
62. Think of Offerboat as your go-to marketplace for finding and renting the perfect boat. We’re here to help you access our services and connect you directly with boat Owners, making it super easy for you to find that sweet ride for your next adventure. Whether you're looking for a powerboat, sailboat, yacht, or kayak, we've got you covered!
63. Just a quick heads-up: our services are all about helping you book boats, and that’s it! Offerboat doesn’t control what goes into the listings or the condition, legality, or suitability of the boats. Because of that, we can’t take any responsibility for the listings or the boats themselves. So, just keep in mind that all bookings are made at your own risk, whether you're the Renter or the Owner. Happy boating!
64. Before you jump into using our services, let’s go over some important things you need to agree to. First off, if you’re going to operate a boat, make sure you have the right skills and are legally authorized to do so in the area where you’re renting. And remember, don’t let anyone else operate the boat unless they’re also qualified! You also need to have the legal authority to make binding commitments and promise to use our services according to our terms. You're here to post or view boat rentals and handle legitimate rental transactions for yourself or someone you’re authorized to act for, so if you’re booking for someone else, be sure to inform them about the terms and conditions and any laws they should know about. If they need to sign a separate rental agreement, that’s on you to make sure it happens. Always provide us with accurate, truthful, current, and complete information, and if you have an Offerboat account, keep your login info safe and confidential. You’ll need to follow all laws regarding boat operation, maintenance, rental, or charter, and if you’re listing a boat, confirm that you’re either the legal owner or an authorized representative of the owner. And just a heads up, you can’t share your account with anyone else or transfer it to someone else. If you’re in an area with age restrictions, follow those rules and remember that our services are only available to those 18 and over, so by using them, you confirm you meet that age requirement. Lastly, Offerboat reserves the right to deny access to our services at any time for any reason, including if the terms aren’t being followed.
65. As a Renter, you’ll need to create an account and set up your payment info for our service fees and any other fees that might come up when you book. It’s super important that you provide all the necessary details, including a valid credit card for pre-authorization, reservations, and payments. When you book through Offerboat, you'll be paying your booking service fees to us so we can connect you with the boat owner who listed their boat on our app. Just so you know, when you give us your credit card info, you're agreeing to a 10% non-refundable booking service fee. This fee doesn’t go toward the rental costs that the boat owner may require. We may use a trusted third-party service provider to securely store your credit card information to help us process payments. By sharing your info with us, you’re okay with that! We promise to work with providers who have strong security measures in place to keep your information safe.
66. Just a heads up: Offerboat isn’t part of any agreements between you and the boat owners. We don’t handle payment collections for rentals, so it’s up to you as the Renter to make sure payments go directly to the boat owner for any rentals you arrange through our platform. If you have any questions about this, feel free to ask! We're here to help.
67. Just a quick reminder: anyone using your username and password will be considered "you." That means they’ll have all the rights and privileges of your account, and you’ll be responsible for anything they do while logged in. So, it’s super important to keep your username and password private—don’t share them with anyone who could pretend to be you when using our Services.
68. If you ever notice any unauthorized use of your account or suspect someone is accessing the Services inappropriately, please let us know right away! We're here to help keep your account safe.
69. We want to make sure everyone has a great experience on Offerboat, so it’s really important to remember that sharing personal contact information—like email addresses, phone numbers, website links, company names, social media accounts, pickup locations, or any other ways to communicate directly outside of Offerboat—is a no-go.
70. Offerboat has the right to keep an eye on things, review content, and block anything that seems like it might go around our platform or violate our terms. If these rules aren’t followed, it could lead to your account being suspended or removed from Offerboat, and that’s totally up to us.
71. We also want to stress that trying to bypass Offerboat in any way—whether it’s through messaging, boat listings, public or private reviews, or even images you upload—isn’t allowed.
72. By using our Services, you’re agreeing to these terms, and just so you know, any violations could have serious consequences, including losing access to the platform. Thanks for helping us keep Offerboat a safe and fun place for everyone!
73. Hey there, renters! Just a quick reminder: it’s super important to return the boat in the same condition you found it. We know you’ll take good care of it! Just so you know, you’re responsible for everything that happens to the boat while it’s in your hands, including any actions by your guests.
74. We also want to make it clear that Offerboat isn’t liable for anything that happens while you’re on board. Both you and the boat owner agree to keep us out of any issues that might come up. So, if anything goes awry, you’re all set to handle it directly with the boat owner.
75. Oh, and just to clarify, we don’t hold a security deposit for any damages. Any disputes about damages will need to be sorted out between you and the boat owner. Thanks for understanding! We hope you have an awesome time on the water!
76. Hey there! We wanted to give you a heads-up about our Booking Fee. When you use the Offerboat app, there’s a service fee of up to 10% of the total rental amount. This fee helps us connect you with the boat owner but doesn’t go toward the actual cost of renting the boat. You’re responsible for covering the full rental costs directly to the boat owners.
77. When it comes to payments, we’ve got you covered! Offerboat will handle any currency conversions for you. Most transactions are processed in US dollars unless we specify otherwise. Just a quick note: a currency conversion fee of 3% of the total rental amount will apply, and we might adjust the conversion rate based on when you make the payment.
78. Also, keep in mind that we may modify our Transaction Fees from time to time. If we do make any changes, they’ll take effect on your next booking after the adjustment. Don’t worry; any rentals you’ve already booked will stick to the fees that were in place when you made that booking. Thanks for being part of the Offerboat family! We hope you have a fantastic experience out on the water!
79. Just a quick note: Offerboat doesn’t handle or process any payments to boat owners for rentals made through our app. It’s up to you and the boat owner to work out the payment details and ensure everything is agreed upon. We’re not part of the actual rental transaction or the money transfer, so you and the owner will coordinate directly on that front. Thanks for understanding, and happy boating!
80. If a boat owner doesn’t respond to your booking inquiry, we may step in and reassign the booking to another owner on your behalf. We want to make sure you have a smooth experience!
81. We also take your safety seriously, so if we have any reasonable suspicions of fraudulent activity or anything unusual related to the rental or payment process, we reserve the right to remove members.
82. Additionally, if we find any listings that contain content we consider unacceptable, we may remove them from our platform without prior notice. This includes anything that could pose risks like fraud, identity theft, or breaches of personal privacy. Thanks for being a part of our community, and let’s keep it safe and enjoyable for everyone!
83. We want to make sure you have a great experience, so it’s good to know that sometimes the boats or watercraft you’ve reserved might need repairs or could be unavailable for your reservation. If that happens, don’t worry! The boat owner may offer you a substitute that closely matches the age, size, model, and value of the original boat you wanted. We’re here to help ensure you still have a fantastic time on the water!
84. Just a quick heads-up: Offerboat isn’t involved in the actual transaction between you and the boat owner, so we don’t handle any payments related to your boat rental. This means we also don’t collect any taxes or fees that might be required by local, state, or federal authorities.
85. So, both you and the boat owner are responsible for your own tax obligations. If you’re the boat owner who accepted a booking, you’ll need to manage the collection, reporting, and payment of any taxes that apply. It’s a great idea to check in with your legal or tax advisors if you have any questions about that.
86. Oh, and if you're in the European Union, remember to include VAT in your booking price! You’ll also need to take care of reporting that, too. Thanks for understanding, and happy boating!
87. We know that verifying user identities online can be tricky, and while Offerboat does its best, we can’t take responsibility for confirming the identities of every Renter or Member. That said, we might ask you for some reasonable proof of identity, so we appreciate your cooperation with that!
88. To keep everything secure, here are a few things we ask you to do: (i) Please make sure to keep your password and online ID for your Offerboat account—and your email account—safe and confidential. (ii) If you ever suspect that your credentials might be compromised, let us know right away and choose a new online ID and password. (iii) If you get any messages from someone asking for your online ID or password, please inform us immediately.
89. We really encourage you not to share your online ID or password with anyone. If you do decide to share your credentials or don’t take care of them properly, you’ll be responsible for any transactions that happen under your Offerboat account or email, even if they weren’t authorized or were fraudulent. Thanks for helping us keep things safe and secure!
90. You understand that Offerboat is all about providing its Services "AS IS" and "AS AVAILABLE." That means there aren’t any guarantees or warranties attached—Offerboat, along with everyone who’s part of the team, like our officers, directors, and suppliers, is stepping back from any promises. This covers everything, including implied warranties about title, merchantability, non-infringement, and suitability for specific purposes. So, while we strive to offer a great experience, we can’t promise that the Services will run smoothly all the time, without interruptions or errors, or that there won't be any security hiccups along the way. The Services are here for you on an as-is and as-available basis, so your use of them is at your own risk. We want to be upfront: to the fullest extent allowed by law, we don’t offer any guarantees or warranties—express or implied—about the Services. This includes things like implied warranties of merchantability and fitness for a particular purpose. While we strive for accuracy, we can’t promise that everything you find on our Services or linked sites is perfect. If something goes wrong—like personal injury, property damage, or even pesky bugs and viruses—you agree that we’re not liable. We also can’t take responsibility for any third-party products or services you might encounter through our Services. So, always trust your instincts and stay cautious when navigating these waters!
91. Just so you know, Offerboat and its partners don’t make any promises about the accuracy of the info shared by Renters or Members, or whether boat rentals will actually be available at the advertised times, locations, or prices—even if your reservation is confirmed. There’s no guarantee that the boats will meet legal or safety standards, and your experience with the Services might not meet your specific needs or expectations. Plus, we can’t promise that the Services will always run smoothly, on time, or without any errors. While you might find information through the Services, we can’t vouch for its accuracy or reliability, and we don’t guarantee that any software we provide will be free of bugs. Just a heads-up: some places might not allow these types of exclusions or limits, so this may not apply everywhere.
92. Just a heads-up: Offerboat and its team—like our officers, directors, and everyone else—aren't liable for any direct or indirect damages you might face while using our Services. This includes anything from issues with advertised boat rentals to any data hiccups, even if we were warned about the possibility. If you rely on ads or get into a deal with someone you found through our platform, that’s on you. We also can’t be held responsible for any modifications we make to our Services, any interruptions you experience, or if you don’t keep your account info secure. Also, if something goes wrong during a boat rental—like an accident—know that Offerboat isn’t part of that rental agreement and isn’t responsible for injuries or damages. Your rental is at your own risk, and if we were ever found liable for something, our total responsibility would be limited to either the service fees you paid or a maximum of $100. Just keep in mind that some places might not allow these limits, so this may not apply everywhere.
93. If any disputes pop up between a Renter and a Member, both parties agree to back Offerboat and its team—like our directors, officers, agents, and employees—by covering any claims, losses, damages, or costs that come up from those disputes. This includes everything from legal fees to any other expenses related to the issue. It doesn’t matter whether the claims are known or unknown, as this protection covers disputes about breaches of this Agreement, other agreements, or issues with rental units. Plus, both the Renter and Member also agree to hold Offerboat harmless from claims related to their violation of these Terms, any applicable laws, or infringement of anyone else's rights, along with their use of the Services. Just so you know, Offerboat isn’t obligated to step in or resolve disputes between users, unless it's specifically mentioned in these Terms of Use.
94. The Services include a variety of proprietary materials that make everything come together beautifully, like videos, audio, graphics, music, photos, text, software, and our eye-catching logos. Offerboat owns or has licensed all these materials, keeping all the associated intellectual property rights safe and sound, including copyrights and trademarks. When you use the Services, just remember that you can’t upload, download, distribute, or reproduce any of these proprietary materials without getting written permission from us first. That said, feel free to make a few copies of your booking documents and related materials for your boat rentals arranged through the Services!
95. Sometimes, users have awesome ideas or suggestions for our business, like tech innovations, marketing strategies, new product proposals, website enhancements, or even catchy product names. While we genuinely appreciate your creativity, it’s good to know that we don’t actively seek out these ideas and aren’t obligated to review or consider them. If you decide to share any of your ideas, original works, or suggestions (let's call them “submissions”), keep in mind that this policy helps us avoid any potential misunderstandings or disputes if our business—like our products, websites, or marketing approaches—ends up looking similar to what you’ve suggested. So, we love that you want to share your thoughts, but just a heads-up on the ground rules before sending anything our way! When you send us any submissions, you're giving us the green light to use or share your ideas however we want, without any need to pay you for it. Plus, we’re not obligated to review what you send our way, and we won’t keep it confidential. Just a heads-up, this is all part of how we keep things clear and friendly!
96. We and our users are all about keeping things genuine, so we have a zero-tolerance policy for spam. This means you can’t use the site to send out spam or any content that goes against these terms. Let’s keep it real!
97. Our services might feature links to websites, social media platforms, or other online services that are run by folks other than Offerboat—let’s call them "Third-Party Websites." Just to clarify, these links are there for your information and don’t mean we’re endorsing their products, services, or content, nor do they show any connection to their sponsors or operators. If you decide to check out any of these Third-Party Websites, you’re doing so at your own risk. We can’t take responsibility for what you find on those sites or any resources they offer. Plus, any interaction you have with them won’t be covered by our Terms, so just keep that in mind!
98. You need to follow all relevant statutes, ordinances, laws, and regulations while using our services. It’s important to keep everything above board!
99. Headings are just there for your convenience and don't really define or limit what each section covers or means. They’re more like signposts to help you navigate, not rules that shape the content.
100. You can’t pass along or transfer this Agreement, the Terms, the Services, or any updates to them without getting a thumbs-up from Offerboat in writing. But on our end, we’re free to transfer this Agreement, the Terms, and any info you share without needing your okay. This might come into play if we decide to sell our business, merge, or make similar moves.
101. This Agreement is all about making sure we’re on the same page, and it’s governed by the laws of Florida, USA—no conflicting laws to worry about here! We’ve written everything in English, and we’re waving goodbye to any rules that might suggest a different legal language or location. Plus, just so you know, this Agreement doesn’t fall under the United Nations Convention on Contracts for the International Sale of Goods.
102. By diving into our Services, you’re giving a thumbs-up to handling any disputes in the courts of Miami-Dade County, Florida, U.S.A. So, if anything comes up related to the Terms or your experience with us, that’s where it’s all going down!
103. We totally get that sometimes things don’t go as planned, and we want you to know that Offerboat isn’t responsible for any delays or hiccups with bookings or Services if they’re caused by events beyond our control. This covers everything from acts of nature, like storms or floods, to unexpected issues like strikes or even government regulations. So if something comes up that’s out of our hands—like a mechanical problem or bad weather—we appreciate your understanding as we navigate those challenges! By using our services, you agree to release Offerboat from any claims or demands for direct or consequential damages that may arise if we can't perform due to a force majeure event or any of the other circumstances we mentioned earlier. We really appreciate your understanding, as this helps us keep our commitment to providing you with top-notch service, even when unpredictable challenges pop up!
104. If a court finds that any part of these Terms is invalid, illegal, or unenforceable, no worries! The rest of the Terms will still be good to go. We’ll make sure to interpret the valid sections in a way that reflects the original vibe of the part that didn’t quite fit. So, we’re all about keeping things smooth and ensuring the spirit of the Terms stays strong!
105. Just so you know, if we don’t enforce a particular part of these Terms, it doesn’t mean we’re giving up on any other parts. Each provision stands on its own, and we’re still committed to upholding the entire agreement!
106. These Terms are the full package between you and Offerboat when it comes to everything we’ve talked about, including how you can use our Services. They take the place of any previous chats, agreements, or understandings—whether we discussed them in person or in writing—so you know exactly what’s what!
107. If you happen to break the Terms, Offerboat has the right to give you a warning or even temporarily or permanently suspend your access to all or part of our Services. We can take this action whenever we feel it’s necessary and for any reason we choose, so it’s always a good idea to play by the rules!
108. At Offerboat, we treat all Members equally and don't play favorites, so we won’t advise you on who to choose for rentals. Any comments or reviews you see from our users—like Renters or Members—are their personal opinions and don’t necessarily reflect our views. Unless we say otherwise in writing, you can assume we're not backing any particular comment or review.
109. Just so you know, by agreeing to this, you recognize that there’s no joint venture, partnership, agency, or employment relationship between you and Offerboat from this Agreement or your use of our Services. We're just here to provide you with great options!
110. Just a quick heads-up: if you have any disputes related to the Terms or your experience with Offerboat's Services, please let us know in writing within thirty (30) days from when the issue occurred. If you don’t reach out within that time frame, you’ll be waiving your right to pursue any claims against us. We want to make sure we can help you out, so don't hesitate to get in touch!
111. If you have any questions, concerns, or just want to chat about this Agreement or our Services, we’re all ears! Reach out anytime at support@offerboat.com. And just a heads-up, all rights not specifically given here are still reserved by Offerboat. Thanks for being a part of our awesome community!
112. Let's break down what we mean by these terms in a friendly way! A “Bareboat Rental” is basically when you sign an agreement to take full control of a boat for your adventures, which means you're responsible for everything from manning it to stocking it with supplies during your rental period. When we say “Boat(s),” we’re talking about any type of marine vessel you might want to rent. Now, “Offerboat Content” includes all the cool stuff we provide through our services—think text, images, videos, and more—while “Collective Content” is a mix of both Offerboat Content and any material contributed by our awesome Members. Speaking of Members, a “Renter” is someone who books a boat through us, while an “Owner” is the one managing that boat listing and making sure everything goes smoothly. A “Listing” is just a boat that’s available for rent. “Member Content” is all the stuff you upload or share with us, and our “Service Fee Policy” outlines the fees you might encounter during your transactions. A “Time Charter” is when the boat owner keeps responsibility for running the boat but lets you enjoy it. Lastly, “Tax” covers any sales or service taxes that might apply. Just remember, some sections of our services might have their own specific rules, and if there’s ever a conflict, those will take precedence. Happy boating!
113. At Offerboat, we've got a lot of creative juice flowing, and we take pride in all the intellectual property that makes our services unique! Basically, we're the proud owners of everything you see and use, from our source code and databases to the cool designs, videos, texts, and images that come together to create an awesome experience for you. This also includes our trademarks, service marks, and logos that you see throughout our platform. All of this content is protected by copyright and trademark laws, both here in the U.S. and around the world, so we can keep everything safe and sound. While you're welcome to enjoy our content, remember it's meant for personal, non-commercial use only—so go ahead and explore, but keep it casual and friendly!
114. As long as you follow our Legal Terms—including the "PROHIBITED ACTIVITIES" section—Offerboat is excited to give you a limited license to access our Services and download or print any of our accessible content for your personal, non-commercial use. Just a heads-up, though: unless we say otherwise, you can’t copy, reproduce, distribute, or sell any part of our Services or content for commercial purposes without getting our express written consent first. If you’re looking to use our Services, Content, or Marks in a different way, feel free to reach out to us at support@offerboat.com. If we give you the go-ahead, make sure to credit us as the owners and keep any copyright notices visible with your content. Remember, we keep all rights not specifically granted to you regarding our Services and content. If you don’t respect these Intellectual Property Rights, it’s a serious breach of our Legal Terms, and we’ll have to terminate your access to our Services right away. So let’s keep it cool and respectful!
115. We really want you to take a moment to check out this section and the "PROHIBITED ACTIVITIES" part before diving into our Services so you can fully grasp (a) the rights you’re giving us and (b) the responsibilities you take on when you share or upload any content. When you send us questions, comments, ideas, or feedback about our Services (let’s call these "Submissions"), you’re giving us all the intellectual property rights tied to them. That means Offerboat can own and use those Submissions however we like—commercially or otherwise—without needing to credit or compensate you. Plus, when you interact with our Services through chats, blogs, or forums, you might create what we call "Contributions," which could include everything from text and videos to photos and personal info. Just a heads-up: anything you post publicly will be visible to other users, so keep that in mind!
116. While we’re not required to keep an eye on Contributions, we do have the right to step in and remove or edit any Contributions if we think they’re harmful or go against our Legal Terms—no prior notice needed. If we do decide to take action, we might also suspend or disable your account and let the right authorities know. So, it’s a good idea to keep things respectful and in line with our guidelines!
117. When you use our Services, you’re promising us a few important things: (1) that all the registration info you give us is truthful, accurate, up-to-date, and complete; (2) that you’ll keep this info accurate and update it when needed; (3) that you have the legal capacity to agree to these Legal Terms; (4) that you’re not a minor where you live; (5) that you won’t access our Services using automated means like bots or scripts; (6) that you won’t use our Services for anything illegal or unauthorized; and (7) that your use won’t break any laws or regulations. If you provide any info that’s untrue, outdated, or incomplete, we might have to suspend or terminate your account and deny access to the Services now and in the future.
118. To access our Services, you might need to register, and when you do, it’s super important to keep your password safe and confidential. You’re responsible for all the activity that happens with your account and password. If we ever find that your username is inappropriate, obscene, or just not cool, we reserve the right to remove, reclaim, or change it. So, make sure to choose wisely!
119. Just a quick note: all sales are final, so we won't be able to issue any refunds. Thanks for understanding!
120. It's super important to remember that you should only access and use our Services for their intended purpose. Our platform isn't meant for any commercial activities unless we've specifically given the green light. As a user, there are a few things we need you to avoid: don’t try to scrape or gather data to create your own database, and definitely don’t mislead us or others, especially when it comes to sensitive information like passwords. It’s also a no-go to mess with our security features or use the Services in a way that could hurt us or others. Please don’t harass or annoy our team, try to bypass our security measures, or use automated systems to interact with the Services. Remember, we want to keep this community safe and enjoyable for everyone, so please stick to the rules and treat everyone with respect!
121. When you use our App, you get a limited, non-exclusive right to install and use it on your own devices, but this comes with some important ground rules. First off, don't try to reverse engineer, modify, or create anything new based on the App. Also, it’s crucial to stay within the law while accessing the App—no removing any copyright or trademark notices either! We really want you to enjoy the App for what it’s meant for, so please don’t use it for commercial purposes or let others access it simultaneously. If you're downloading the App from the Apple Store or Google Play, keep in mind that your use is also subject to their rules. We're here to provide maintenance and support, but the App Distributors aren’t obligated to do so. If there are issues with the App, they might refund your purchase, but that's about it! Make sure you’re not in a country with restrictions, and follow any third-party agreements as well. Lastly, know that the App Distributors can enforce these terms, so let's keep it all above board and enjoy using the App!
122. We give advertisers the opportunity to showcase their ads in specific spots on our Services, like sidebar or banner ads. Just to be clear, we’re just the space providers for these ads and don’t have any other relationship with the advertisers. So, if you see an ad, it’s all them!
123. We totally have the right—though not the obligation—to keep an eye on the Services for any violations of these Legal Terms. If we spot anyone breaking the law or our rules, we won’t hesitate to take action, which might include reporting them to law enforcement. We can also choose to limit your access to or even disable your Contributions if we think it’s necessary. Additionally, if any files or content are too large or causing issues for our systems, we may remove or disable them without any prior notice. Ultimately, we’ll manage the Services in a way that protects our rights and ensures everything runs smoothly!
124. We totally get that your data privacy and security are super important! Check out our Privacy Policy to see how we handle things. By using our Services, you’re on board with our Privacy Policy, which is part of these Legal Terms. Just a quick note: our Services are hosted in the U.S. If you’re joining us from another part of the world with different data laws, you're cool with transferring your info to the U.S. and letting us handle it here. Thanks for being part of our community!
125. These Legal Terms are in full effect while you’re enjoying our Services. Just a heads-up: we have the right to deny access to anyone at our discretion, without any notice or liability, for any reason—or even no reason at all. This includes blocking specific IP addresses if necessary. If we find a breach of any part of these Terms or applicable laws, we can terminate your access to the Services or delete your account and any content you posted, all without warning. If we do need to suspend or terminate your account, you won't be able to register again under your name, a fake name, or anyone else's name—even if you’re acting on someone else's behalf. Plus, we may pursue legal action if necessary, including civil, criminal, and injunctive remedies. Thanks for understanding!
126. We want you to know that we can change, modify, or remove anything from our Services whenever we feel like it—no notice required! While we do our best to keep things updated, we're not obligated to refresh every piece of info all the time. We might also tweak or discontinue parts of the Services, and we won’t be held responsible for any changes, price shifts, or if something is temporarily unavailable. Sometimes, we might run into hardware or software hiccups or need to do some maintenance, which could cause interruptions. Just a heads-up: we can revise or update things whenever necessary, and you agree that we’re not liable for any inconvenience if you can’t access the Services during those times. In short, we’re here to provide a great experience, but we can’t promise everything will always be up and running. Thanks for rolling with us!
127. To keep things smooth and manageable, if any disputes arise related to these Legal Terms (we'll call them "Disputes"), both you and we agree to take a friendly approach first. Before diving into arbitration, let’s give informal negotiations a shot for at least thirty (30) days. This way, we can try to sort things out together without jumping into a more formal process. Just a heads-up: these informal talks will kick off once one of us sends written notice to the other. It’s all about working things out the easy way first!
128. When it comes to resolving any disputes, claims, or controversies related to these Terms or the use of our Services (we’ll refer to these as “Disputes”), you and Offerboat agree to go the arbitration route. This means we’ll settle things through binding arbitration rather than in court, except for cases where either of us needs to seek injunctive or equitable relief to protect our intellectual property rights. Just a heads-up: by agreeing to this, you’re waiving your right to a jury trial or to be part of any class action lawsuits. Also, unless we both agree otherwise in writing, the arbitrator can’t combine claims from different people or oversee class actions. If this part about consolidation isn’t enforceable, then the whole “Dispute Resolution” section will be void, but don’t worry—this section will stick around even if our agreement ends.
129. When it comes to resolving any disputes about these Terms or our Services, you and Offerboat agree to go the binding arbitration route instead of heading to court—this means waving goodbye to jury trials and class actions! If we need to make a change to this section, you can let us know within 30 days, and we’ll stick to the original terms. Also, while you might find the occasional typo or error on our Services, don’t worry—we’ll take care of any corrections and keep everything up to date without prior notice. Just remember, if a dispute arises, you’ll need to bring it up within one year, or it’s off the table!
130. When you visit our Services, shoot us an email, or fill out any online forms, you’re engaging in electronic communications. By doing this, you’re giving your thumbs-up to receive communications from us electronically, whether it’s through email or right here on the Services. This means all agreements, notices, and other info we send your way electronically count as if they were delivered in writing. You’re also on board with using electronic signatures, contracts, and records for any transactions we handle through the Services. Plus, you’re waving goodbye to any laws that require traditional signatures or paper records, making everything easier and more streamlined for you!
131. Hey California users! If you ever find yourself with a complaint that we haven’t quite resolved to your satisfaction, don’t hesitate to reach out to the Complaint Assistance Unit of the Division of Consumer Services. You can drop them a line in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or give them a call at (800) 952-5210 or (916) 445-1254. They’re there to help!
